Law enforcement and legal requests
This page describes how Kisscode LLC (a Wyoming LLC, San Francisco, California), operator of KissCode (kisscode.ai), handles requests from law enforcement and other legal authorities. KissCode is an AI-companion service for adults 21+. Members talk with AI agents, not with other people, which limits the data we hold, but we do hold account, payment and chat records and we take legal process seriously.
1. Where to send a request
- Email: hello@kisscode.ai, subject line "Legal request". This is the only channel we accept for legal process.
- Send it from an official government email address, on agency letterhead, signed, with the case or reference number, the name, title, badge or ID number and direct phone number of the requesting officer.
- Name the account precisely: the email address, phone number or account ID, the date range, and the exact data wanted. Requests that are broad or vague will be sent back for narrowing.
- Requests sent through chat, social media or to the AI agents are not processed. The agents cannot receive or act on legal requests.
2. Step by step: how we handle a request
- Receipt. The request is logged the same day with the date, agency, reference number and the account concerned. We acknowledge receipt within 2 business days.
- Verification. We confirm that the sender is a real government authority: we check that the email domain is official, call the agency back on a publicly listed number, and confirm the officer's identity. We do not release anything to an unverified requester.
- Legal review. Our legal contact reviews the request for validity, jurisdiction and scope. We require the right legal instrument for the data type, as described in section 3. We object to or narrow requests that are overbroad, unlawful or lack proper authority.
- Account notice. Unless the law or a court order forbids it, or the case involves a risk to a child or someone's life, we tell the member about the request before we release data so they can object.
- Preservation. On a valid written preservation request from a government agency we preserve the named account's records for 90 days, extendable once for another 90 days, while formal process is obtained. Preserved data is not released without valid process.
- Response. We release only the data the instrument covers, in a standard digital format, sent by secure transfer to the verified official address. The target response time is 10 business days, faster for urgent matters.
- Record. We keep a log of each request, what was released, to whom and when, and keep the request and our response for 5 years.
3. What we require and what we can provide
- Basic subscriber information (name, email, phone number, sign-up date, last sign-in, payment status): a subpoena or equivalent legal process.
- Messages, chat history, call recordings and transcripts, photos, and other content: a valid search warrant or court order issued by a court of competent jurisdiction. We do not release content on a subpoena alone.
- Payment details: card numbers are held by our payment provider (Stripe), not by us. We can provide the transaction history we hold; card-level data must be requested from Stripe.
- Requests from outside the United States must come through a mutual legal assistance treaty (MLAT) or a US court order.
- We do not provide data for civil disputes without a court order, and we do not respond to requests from private parties as if they were law enforcement.
4. Emergency requests
If a person is in immediate danger of death or serious physical harm, an authorized law enforcement officer may send an emergency disclosure request to hello@kisscode.ai with the subject "EMERGENCY". State the nature of the emergency, the person at risk, the data needed and the officer's direct phone number. We review these as soon as we see them, verify the requester by calling back, and release the minimum data needed to address the emergency. A formal request is then expected afterward. If you are in danger, call 911 first.
5. Child safety reporting
- KissCode is for adults 21 and over. We do not allow any content that sexualizes or exploits anyone under 18, real or AI-generated.
- When we find or are told of apparent child sexual abuse material or child exploitation, we remove the content, close the account, preserve the records, and report to the National Center for Missing and Exploited Children (NCMEC) CyberTipline as US law requires (18 U.S.C. 2258A). We cooperate with law enforcement follow-up on those reports.
- We also report suspected human trafficking and other serious harm to the proper authorities.
6. Members and transparency
- Our Community Guidelines and Acceptable Use Policy prohibit sexual violence, child exploitation, fraud, commercial sex and trafficking. Violations lead to removal without refund and, where required or appropriate, a report to the authorities.
- We keep data only as described in our Privacy Policy. Data that was deleted and has passed its retention period cannot be produced.
- If we decline or narrow a request, we tell the requester why.
